Our Advisors are designated Return-to-Work and Disability Management specialists who can lead you through the process of returning to work after an absence and requesting leave from work. It’s essential to know that any leave of absence requests, accomodation, or return to work plans, require you to provide adequate medical documentation. Unfortunately, most employers receive insufficient medical documentation that results in unnecessary delays or fails to meet criteria that can justify change.

If you have a disability that impacts your ability to work at full capacity, do you know your rights under the Human Rights legislation act? Employers have a legal responsibility to accommodate your needs if you have a disability that limits your ability to perform a job. Your rights apply if your disability is permanent or temporary and regardless of whether the basis of your condition is occupational or personal. Your Workability Advisor will mentor you through the process of providing medical proof to your employer during these situations.

EMPLOYEE ACCOMMODATION PROCESSES

A “permanent functional impairment” indicates a persisting cognitive or physical limitation that has not resolved or is unlikely to change. Under these circumstances, an employee can request a “Medical Accommodation” of their job duties if appropriate medical documentation supports that they have a permanent condition which restricts them from carrying out their work. In these cases, an employer must accommodate that request to the point of “undue hardship” if the employee is either fully or partially exempt from performing the regular expected job duties or functions. This can create an environment where you can find an objective solution not influenced by emotions.
